What you are running into is the fact that the report writer looks at the "defined" height of the band to determine if there is enough room or whether a page break needs to occur. It does not evaluate everything in the band to see what prints or doesn't print. It just "assumes" that everything will print.

I'm not aware of any way to get around this.
