Problem here in the USA is that when something such as this is too vague, then you have to argue it in court....which means you're going to have to fight Micro$oft and their army of lawyers - needless to say a lowly software developer won't have nearly the resources hat M$ has. Like I said - it's an intentional intimidation tactic.
