I'd loop through the forms collection before trying to instantiate the form to see if it already exists. If it does, I'd activate that form. If not, then I'd run it.

Can you clarify, what sort of problems you would expect? What difference is there between opening two different froms and opening the same form twice? - Assuming proper programming, including private datasessions.
