>>From what I understand - you should have asked for a ruling beforehand - says the lawyer
>>[ yes I know, you did not know. But it's not any different over here - every one is 'supposed' to know the law ]

>In Quebec, we have operated for 7 years in the same way all other e-commerce businesses in Canada are doing. The CRA also did an audit and this has been discussed and they agreed that no tax should have been charged to international customers.

Reading this, Michel, may one conclude that you have handled legally ? I do not understand what the fuzz is about. If they charge you, then they must charge all other e-commerce businesses ...

In fact, if you - or all other e-commerce businesses - have had an audit in the past, it's hard for them to 'claim' taxes now since they have agreed not to, in a way. [ there's an exception to that - over here - if one breaks the law and the auditors do not come across it during an audit, it does not mean it's ok. ]

>So, it made perfectly good sense to operate in the same way in New Brunswick, especially after the CRA confirmed us on phone not to charge the tax, with our accountant as a witness during a conference call. If you can find one e-commerce business in Canada having such ruling, I would be interesting to hear about. Because, having such a ruling, which would state that tax has to be charged, this would mean it would make it impossible to operate so this is why you will probably not find one with such ruling.

Since I'm not living in Canada, it would be hard for me to find such ruling

The CRA should (and probably have) tell you why referring to the law (articles, sections, ...) Having got that you need a fiscal lawyer.

Bonne chance,
Gregory
