Actually, it is the same. People respond differently to alcohol, and blood alcohol levels differ based on metabolism and weight. So I can't have a single drink without being affected by the alcohol (and thus don't drink at all), while I imagine John Harvey, for example, can have a couple of beers without going above the legal limit.

Police stop people for drunk driving based on their driving, not by watching them at the bar first. I'm just suggesting that we stop people for reckless driving based on their driving, not based on whether they're holding a cell phone.
