If there are any that really are innocent, my sympathies go out to them, but I have a fair amount of faith that our military isn't sending people to Gitmo for fun. My guess is they are just what we call them - enemy combatants.

If they could be considered POWs then they do fall in the category of spies as they fighting w/o being in uniform. As they are not fighting for any particular country this really leaves them open to whatever their captors decide. They have no legal protection.

They are taking action against US armed forces so they do qualify as enemy.
