It was the ruling of the California Supreme Court in the first place which changed the constitution and set the events in motion which led to proposition 8. I might add, that polling indicated that the measure was going to fail until Gavin Newsom opened his fat trap and gave the pro-8 crowd the perfect soundbite to rally the voters.
