planning terrorist acts or planning on aiding the act of terrorism but no one was at risk or died. Should be treated similar to those who are caught aranging to pay someone to kill someone else (but the hit never goes through or the person paid was fbi, police, or law enforcement of some other type) or conspiracy to commit murder, etc...
To me this falls more into an act of war category, except the combatant is not wearing a uniform.
