I get to admit I was mistaken again. I just did some research and see she is more liberal than I thought. Not sure where I got the idea she is not. If she is the nominee there will definitely be a battle. For this reason I think Obama will nominate one of the other two whose names have been bandied about. He chooses his battles. I am sure the new justice will be a good one. He or she will not be a conservative rubber stamp like Thomas or Scalito.

Re your issues, same-sex marriage is coming whether you like it or not. It's already here in some states and will be the law of the land in our lifetimes.

Not sure exactly what you mean by informed consent. If you are referring to Bayo v Napolitano, I agree with her position. She basically said non-citizens visiting the U.S. do not waive their rights without knowing clearly that they are doing so.

Re partial birth abortion, don't even get me going on that. It is a rare procedure which was manufactured into a big deal by abortion foes. Their plan was clearly to use an emotional issue to establish a beachhead for eventually reversing abortion rights. Not saying it wasn't a smart tactic, or questioning the sincerity of those who oppose abortion, but let's view it for what it was.
