Words ending with -able (like table, vegetable, stable, objectionable etc) denote a possibility. But this is a business - they have already calculated the odds of anyone bothering to sue them for $9, or any unnamed thousands of such customers ever pooling together for a class suit, and risking that the legal expense and lawyers operating at $2000/hr would leave them with $2 each. Also they calculated that Skype is around for eight years now (or more?), and that it has become a habit (and a network to itself), so their chance of getting return business from those they screwed up aren't null either.
