He was not arrested. There was not going to be an arrest. The judge who otherwise would have issued the warrant stated Monday morning that Perry would receive a summons. But Perry decided to turn himself in.

The first one (abuse of official capacity to harm or defraud) is pure B.S. That will get tossed out immediately.

The second one is going to come to blows with the governor's authority to veto. Perry's legal defense might include a counter-charge that his state constitutional right to veto is being violated. Trust me, no Democratic governor who understands their state constitutions will want to see Perry indicted on this charge.

Think about this for a minute - clearly the majority of those who back this charge are Democrats. It's going to be very hard to argue that executive powers are broad when a Democratic president uses them to defer action against illegal immigrants, but narrow when a Republican governor uses them in a line item vote to cut state funding for a County DAs office. You really want to make that argument? Good luck and god bless.

I admit that Perry isn't the sharpest knife in the drawer and doesn't know when to keep his mouth closed - but I can't see this sticking. This indictment isn't even corrupt - it's moronic.
