128 bit is only available to customers within the US or Canada, where MS can verify either that the customer is physically located within the US or Canada and has signed an acceptance of the agreement not to ship outside the US or Canada, or will permit download from a secure site where they can verify with the ISP that the connection is within the US or Canada and the customer agrees not to ship it outside the confines.
MS does not ship customers the 128 bit version except where the agreement is in place. US and Canadian distribution on CD is the standard 40 bit version.
