That's exactly my point. You came in here as if you were the all-knowing contract guru. Do you read any other tech news besides the M$ driven ZD Net? It doesn't take a lawyers interpretation of a contract to read the news about M$ strongarming companies into supporting what they want or producing whatever benchmark results they want.
I feel sorry for those who wear the M$ blinders because they are so scared of the "New Big Brother".
