That was a trick ? of sorts. The fact is, an enforceable K does not have to be in writing. A K can be gleaned from the objective intent of the parties.

My point here is that just becuase you don't have a written document yet, all hope is not lost. What is important is that anything you thought was binding before, be sure to get it in the written document.
