You were OK up to the point you said "That is up to the users." People on this site have always been telling me that no one would be forced to subscribe to passport. They were wrong. If those gamers want to continue their access to the games they will have to subscribe to passport. Passport is not essential to the game, MS is just changing the rules. It is also interresting to note that even though they were forced to subscribe many of them had problems connecting.
