His email address is at Earthlink, and if he is using Earthlink's SMTP server, I highly doubt that is the problem. They are one of the larger ISP's, and as far as I know, go to great lengths to prevent SPAM from bouncing through their servers...

The first one is to try to have the server owner to do their work and adjust the situation. If they haven't done it so far, then, that shows how responsible they are. So, in either case, I would consider using a more adequate server to send your emails if this can't be adjusted. For us, we stopped accepting mails from a few servers since a few months now and this helps us a lot in several server/client management issues we have to deal with.
