Eric,
you might try using a dialer program to test if the modem is avalabe. We use the MarshallSoft DUN Dialer.
www.marshallsoft.com It only cost about $55 and seems to work very well. I haven't tried this but I would guess that it should return an error trying to dial if the modem is already busy. There may be an easier way through a Windows API call but I haven't a clue on what it would be.
