What are you doing to check and see if the program is "Locked"? It sounds like permissions to me - I don't know why it works once, and not another time. Are you trying to delete a file? Or maybe create a file?
XP is based on NT, and has actual security - where 98 did not. Any user could do pretty much anything to any file in 98/ME. If the actual user that you are running the application under did not create the directory or file, they could not have permissions to work with the file/folder.
