>>You may be right that Michel's only remedy would be a costly legal challenge, but perhaps he has interpreted the ruling too broadly, as far as international sales are concerned. If the ruling is clear on this and there is no more suitable reference, I would cite verbatim the applicable text of the specific ruling in this case. For what it's worth, I'd be glad to sign a petition on Michel's behalf strenuously protesting a ruling that clearly fails to "protect the competitive position" of his business, and which appears to be in violation of fair trade agreements between the US and Canada.

>It is not my interpretation but what I was told by all the representatives who worked on the issue. Yes, we have the ruling on paper which represents the final answer from the government. Yes, we were extremely frustrated about this non sense. When I moved the company to New Brunswick, there were several advantages. But, this one is making all other advantages go away as we are now loosing a lot of money to recover to non collected taxes and also about the impact about members who might decide to not renew.

>I will have a meeting with our local deputy about this. As for a change in the legislation, this is one approach to make. But, this has to go up to the parlement. So, months are within the timeframe here.

>So, for now, in first place, the collection of complains either to HST ruling or to me is one good thing to do. Or, as you said, a petition will also be good.

OK, Michel. Thanks for the additional explanation about all this. As a practical matter, I think a written petition is more likely to get people's participation, although I wouldn't discourage anyone from calling directly. You can count on my signature for sure, and I will renew my PUTM shortly. Another possibility would be forwarding a copy of this complaint to someone at the U.S. Department of Commerce. IANAL, but I do think there may be something to this angle: how would the Canadian bureaucrats feel about a similar tariff being imposed on sales of US products and services to Canada. Some consultation with a lawyer seems advisable, at least to see if such an argument might be made, and to whom. The mere mention of it might just get these people off their asses, before this becomes an international incident.
